Nikolic decision delayed - Audio from the Seymour Stewards room (a must listen).

Danny Nikolic's case which is being heard by VCAT (Victorian Civil and Administrative Tribunal) has been adjourned until November 28.

He is fighting a two year ban from racing after it was alleged he threatened Chief Steward Terry Bailey.

    interesting thing for me, and if you listen carefully, Bailey never questioned Nikolic on "threatening his family or calling him a C**t".
    The only thing he questioned him about was what he said "keep your eye on the road terry" and what he meant by it.

    I might be wrong, but to me, it seems Nikolic's arrogance and recalcitrance (is that a word?), wound Bailey up....and it was only after Nikolic left the room that he began saying he had threatened his family and called him the C word.

    Its quite incredible to listen to. Seems Nikolic has really gotten too big for his boots and had no respect for the stewards. Even the way he questioned the other steward that was in the room.

    DAMIEN Oliver's ride on Europa Point is under police investigation, with new revelations about a top-secret stewards inquiry emerging during the Danny Nikolic hearing.

    An owner of Europa Point, the horse Oliver rode but allegedly bet against at Moonee Valley two years ago, said he had given a statement to investigators.

    West Australian Peter Walsh, part of the syndicate which owned Europa Point, said he had been contacted by Victoria Police officers two weeks ago.

    He said he was asked about bets on the horse and what he thought of the ride.

    Stewards are investigating allegations Oliver placed a $10,000 bet on Octopussy, which beat his mount Europa Point at Moonee Valley in November, 2010.

    "She was ridden on her merits and wasn't good enough," Mr Walsh said.

    "(I told the police) pretty much what I told you. She was given every chance."

    Mr Walsh, from Busselton, said he had known Oliver, a native of Western Australia, almost all his life.

    "We've never had a problem with him," Mr Walsh said.

    Meanwhile, it emerged yesterday stewards are involved in a top-secret inquiry involving a long-serving and respected racing identity.

    The secret investigation emerged during Danny Nikolic's VCAT appeal against his racing ban as steward Terry Bailey sought to explain why he hadn't returned home after his family was allegedly threatened by the jockey.

    Bailey said he had stayed in Euroa on the night of the threat because he had to speak to a well-respected racing identity about a matter that was still the subject of a steward's inquiry.

    Lawyers for Racing Victoria intervened to stop Mr Bailey being quizzed further about the matter.

    Jack Rush QC, for Nikolic, also accused Mr Bailing of giving "spin" when asked about the threat.

    "And if your concerns for your family was such you could have gone home," Mr Rush said.

    "That's what you would have done."

    It also emerged yesterday that Mr Bailey had given a statement about Nikolic's alleged threat to detectives from Purana, the task force probing organised crime.

    Nikolic's fate won't be decided until the end of the month at the earliest. Yesterday's hearing was adjourned until November 28, when Nikolic is expected to be called to give evidence.

    Agree with what you're saying Diva - but I reckon they both need to go...(for different reasons)

    DN has little to no respect left for anyone in a role of authority, and I think Bailey is too highly strung over this whole debacle to be 100% transparent and balanced. IMHO

    Very interesting to hear - and unfortunately no-one is going to win this one - they both need to have a break from racing!

    I may be wrong but i was under the impression that the eyes on the road comment and the alleged family threats were two different incidents. I don't think thats a continuous audio tape and thats why Bailey sounds so fired up in the second part of the audio.

    You may be right runyon - think the two incidents occured across the meeting, that recording sounds like it has been edited/cut down (you can hear the blank bits in between each segment)

    I think what you're seeing is simply the means to get rid of DN for good.

    The motive for which is all the other stuff which remains unproven, although likely factual.

    Good spotting guys, when i listened last night i thought...gee bailey just took off from very litte more than a bit of a bad attitude...but when you realise that the two chats have been morphed into one, it makes a lot more sense..

    Certainly adds a bit of balance to the attitude on the tape..from Bailey...nothing could add balance to DN's attitude

    I remember as a kid sitting in the jockeys room at Ascot when a steward came into the jockeys room and called a jockey (not real name) "Johnson Stewards Room" Johnson replied "what was that Anderson ?
    The Steward replied "you can't call me Anderson"
    Johnson replied " did u call me Johnson, you call me George or Jockey Johnson". Steward was in shock but came back 2 minutes later and said "Jockey Johnson Stewards room please"

    Reports out of Melbourne last week that the Police are closing in on the killer ??
    Lets hope they do a better job than the farrrkwits who went after Raney over here and wasted countless taxpayers $$$ what a disgrace bad police work the dickhead who mentioned Raney as the only suspect is living an easy life up North why wasnt he sacked ??? any wonder they get paid paid crap $$$ and are disliked by most !!

    Recently related a story, can't remember names involved but maybe the sixties/seventies. An apprentice was spruiking about a sling he got for winning a race and a senior jock flashed a WAD and said he had'nt won a race! Glad i don't punt =))

    A senior lawyer has accused one-time glamour jockey Danny Nikolic of being "seriously out of control" claiming he made intimidating and provocative comments to a witness waiting outside his appeal hearing on Thursday.

    Nikolic's already explosive appeal took the dramatic turn when lawyer Phillip Dunn, QC, said he twice made "gun sounds" as he walked past racing steward Wade Hadley during a break in proceedings.

    In his examination of Nikolic, Dunn said the banned jockey then sat next to Hadley, who had previously given evidence against him, and allegedly said: "You're going up in the world, aren't you."

    Having received no response, Nikolic then allegedly said: "I think you're going up in the world, let's see where you end up."

    He then allegedly called Hadley a "f***ing fine specimen of a human being".

    Nikolic denied making the comments, saying Hadley had made the initial contact and he had merely responded.

    "That is an outright and disgusting lie," Dunn said.

    During further questioning, Dunn, who is appearing in the appeal for the Racing Victoria stewards, put it to Nikolic that he had "a real problem. A mental problem".

    Nikolic rejected the suggestion.

    In evidence before the Victorian Civil and Administrative Appeals Tribunal (VCAT) hearing, Hadley said he was shocked and felt threatened by Nikolic.

    He told the tribunal convener, Judge Michael Macnamara, he attempted to ignore Nikolic during the encounter.

    To which Nikolic allegedly responded: "You can't even make f***ing eye contact."

    Hadley also gave evidence on Thursday that Nikolic had made insulting comments to him after he gave evidence at a previous session of the hearing.

    He told the hearing that as he left the witness box, Nikolic had leant forward in his chair and said "you're a disgrace" as he walked past.

    Nikolic is appealing against a two year disqualification handed down by racing authorities who found him guilty of threatening chief steward Terry Bailey at the Seymour race meeting on September 4 this year.

    The Racing Appeals and Disciplinary (RAD) Board agreed with Bailey's evidence that Nikolic had said: "We all have families c***, and we know where yours lives c***."

    At the initial RAD Board hearing Nikolic rejected allegations that he had used other abusive language toward Bailey at Seymour.

    But he admitted at his appeal hearing on Wednesday that he had used the language alleged, although he denied making the threats that led to his disqualification.

    The hearing has been adjourned until December 11 when closing submissions will be made.

    my mind works like this rio.......
    any trainer or owner that uses a rider that is proven to be a crook, is the same in my opinion.
    why would an honest person use a known crook?
    and it is quite interesting, when you see the trainers that keep on supporting them,as they themselves often have history.
    and before the blatherer comes on here throwing tantrums, i am referring to victoria, but.........

    excactly how i feel carey...you use whoever you use, but once they get proven to be a fraud you dont use them again... there are some circumstances when you will....But the degree to what this chap is showing his true colours you'd have to have a few problems yourself to put him on...IMO

    Danny you fell for the 3 card trick.Surely Baillie was showing an abuse of power when he decided to harangue Danny at Seymour.He asked him what he was referring to with"keep your eyes on the road Terry".Danny answered the question then Baillie continued asking him what he meant.Its all pressure for your tiny brain Danny.Your fending off allegations your invoved in a murder.Your $1.03.They've offered a million reward which means your not safe from any quarter.they throw a smokey in by naming a former afl player friend of the Moran crime family.you went,phew.The police statement was they are looking at a number of people and refuse to rule anyone in or out.They make sure Baillies mate from Tasmania sits next to you at the enquiry yesterday.You have a brain snap abusing him and while all this is going on they are investigating several of your race rides.If your head doesn't hurt Danny it should
