Prior to correct weight it was established that SESSWA had raced and won in blinkers which was not
advertised as part of its approved gear for this event. Trainer D Morton was questioned by Stewards
following the race and he advised that after conferring with his stable staff, he was under the incorrect
assumption that the filly was racing in blinkers today and fitted such gear accordingly. This error was
not detected as part of the pre-race gear and equipment checks prior to the race. Stewards reinforced
with the official responsible for the checking of gear prior to each race that the appropriate systems
are in place to ensure that all gear being worn is verified as correct in the parade area prior to the
horses entering the track. Trainer Mr Morton was advised that as the filly won today with blinkers on it
must continue to race with this piece of gear for its immediate future starts. Mr Morton pleaded guilty
to a charge under AR106 for negligence in fitting blinkers to SESSWAR which was not part of its
approved gear. Mr Morton was fined the sum of $500. When assessing penalty, Stewards considered
his guilty plea, prior record good under this rule, that his error was due to an act of negligence and
was unintentional, and the seriousness of the breach as it is imperative that all runners compete in
their approved gear at all times.
