Anyone caught up with story on Perthnow in regards to jockey's wanting to receive super payments from the ARB who reckon it's up to the owners to cough up, I thought jockey's are self-employed so they should be liable to pay their own super.

Can someone with more computer experience put the story from Perthnow on here as I think this a very worthwhile topic for all of us to discuss.

Thanks Rio that's what I thought they are basically sub-contractors.

:-?   It doesn't say who is deemed to be the employer - seems the ATO will make that decision, until then nothing can be resolved

Doesn't matter if they are a sub-contractor if they work for the same employer for more then 80% of the year they are deemed employees and therefore entitled to Super. Determining who the employer is will be where the problem lies but if they get there cheques from RWWA (no idea there) then you would deem them to be there employer you would think

May have shot themselves in the foot -

"And if we are deemed (by the ATO) to be the employer who must pay the
superannuation, we will pull out of facilitating their riding fees and
they can collect their own fees (from owners and/or trainers)."

They are on a good wicket - turf club pays them and chases the dollars - if this happens they will need an acc receivable dept =))

wouldnt be too many that would ride for one person 80% of the time - another can of worms opened

geez, my jockey would have no trouble keeping the weight off if he had 80% of his rides on my chaff burners!!!!

If the owner is deemed the employer then they would be contractors for sure....they are riding for so many different owners.
So it's rwwa paying their super, or no one.

RWWA doesn't employ them..they just do the funds collection for them..it is the owner or trainer on behalf of the owner who actually employs them for each specific ride..

If it was RWWA they'd just allocate jockey A to horse B and different every week

Question of super is answered then :D

aint that easy???? NOT!!!!!!! not having one single owner who employs them the majority of time has to mean they pay there own....but not according to the ATO??!!!!!??
    8-} :-??

Owners don't deduct their tax, or give them holiday pay, or maternity leave. I can't possibly see how they would be responsible for their super.
Same as you don't pay your lawnmower mans super, or your electrician...etc

The ATO will make the decision and if need be they will pay for some-one to challenge it in court.

:-w a while to go yet

Super inclusive or not, I actually think their riding fees are a bit steep for some of the rides i have seen recently.... On the other hand i would have no problem putting D Oliver on retainer.

The owners engage the jockey but it is RWWA that pays them. The owners are not charged the riding fee as I understand it.

    it reads

Unlike most other elite sportsmen and women, Jockeys are responsible for
their own Public Liability insurance cover and the AJA will continue to
work on their behalf to obtain the best terms for the best price.

    it is old info though

The errr locals won by a TKO the jockeys headed back to Perth worse for wear all over a game of pool at the commie
