Danny Nikolic found guilty, to be sentenced in 2 weeks.

    I'm surprised by the length of sentences imposed Australia wide, but for this charge with the allegations levelled, I can't see how he will get less than 12 months.

     

    Anyone else want to have a guess and see how close we get ?

    I don't think i really care but this whole case annoys me. From what i've been reading the hearing basically accepted baileys word over nikolics. As far as im concerned bailey should get whatever nikolic gets.

    So let me get that right VORG ,it was Nikolics word against Bailey so Bailey should get the same  lol lol lol its a no brainer he is a dishonest greedy little runt [DN ] 5 years will be just dandy the least we see of him the better he is bad for racing and more importantly TURNOVER !!!

    Which case has he been found guilty for?..is it the racing fixing? Or threatening bailey? Or having something to do with the murder of his father in law?....

    He'll be sentenced to two Death Sentences.......to be carried out concurrently.

    What I find funny about the story is how his solicitor took the "dumb plea"

    ie, my client wouldnt be dumb enough to threaten a steward like that....

    I think this case is total joke how can you be found guilty without physical proof it is just one man's word against another and don't think all steward's are squeaky clean just look at the mess in NSW harness racing, no proof no case it will just goe to higher and higher courts and in the end be thrown out then Danny will sue  the pant's off them

    Spudley this isnt a total joke this bloke deserves all he gets we are all punters and it shits me knowing we have been throwing cash at races and this little turd and his midget mates have been playing hooky for a long time everyone in Melbourne racing circles new he was at it farkk him i say i hope he ends up driving taxis or working at Hungry Jacks couldnt happen to a nicer wanker !!!sorry about the swearing but this bloke is rotten and has been for a long time and wonder the big stables dont put him on anymore send him to the trotting world he will fit right in there .

    The point is that its his word against baileys word. I don't see how they can come to any conclusion without as spudley said any physical evidence.

    I guess it goes like this. If you were a petty criminal and you threatened the safety of the family of the Police commissioner and it went to court, they would be likely to believe the evidence of the commissioner over the petty crim.
    the top man's honesty and integrity should be beyond question in all cases. If that is not the case, then racing in victoria is totally doomed.
    I think I know who I would be believing. You cant just throw the case out and say "we couldnt prove either way, so carry on as if it never happened". a decision had to be made either way.

    What makes Danny Nikolic an unreliable witness?

    Does he have a serious criminal history? Is he a "petty criminal" as Diva puts it? I don't know.

    We all may have our suspicions re Nikolic and his criminal associations, but if it cannot be proven then you cannot take someone's livelihood away from them.

    I would think you would have to have good reason to call someone an unreliable witness. ie: proof he had lied previously or a third party witness/testimony.

    Perhaps could be a valid grounds for appeal.

    bet he rides right thru the carnival with the appeal heard early november.

    I didnt say he was a petty criminal. I likened the situation to a petty criminal threatening the top of the policing chain.
    How would you know if he was a reliable witness or not, you werent at the hearing? The appeals board must have had reasons for stating he was unreliable....perhaps he kept changing his story...who knows, we weren't there!

    The Chief steward and a jockey having a verbal confrontation on a racecourse and no one else heard anything.

    I`m not sure that blind faith in the stewards department is a good policy.

    Regardless of what people think of Nikolic, surely there needs to be some sort of evidence.

    You are missing the point Diva. I never said he was a reliable witness, I just asked what makes an unreliable witness.

    Perhaps he did change his story, who knows? Would want to be a good reason to stand up in court.

    I also think that blind faith in the stewards department may not be a good policy.

    it appears just you, as this photo suggest could easily happen with no one around, and if DN was too say anything, you think he would do it with witnesses ?

    That photo doesn`t suggest much to me.

    Perhaps a wide angle shot would tell a bit more.

    Unless  they whispered to each other, anyone within 10m would be able to hear.

    My point was, DN would be a dumb arse if he was going to threaten someone when there would be witnesses around. Have a read and it is reported that no one else was around.     Its obvious you and others have decided he is guilty.

    He may well be, but the way it has been handled is ordinary to say the least.

    The Chief Steward has previously stated that it is an unworkable situation and then we get the story about threats that only the Chief Steward heard.

    I don`t think it does a lot for the Chief Stewards credibility.
