A new Australian Sales Thoroughbred Code of Conduct was released on Wednesday by the industry?s eight major participants in order to bring greater transparency and accountability to agents acting on behalf of buyers.

In a first, the code has been signed by The Australian Racing Board, Thoroughbred Breeders Australia, Magic Millions, William Inglis and Son Ltd., Federation of Bloodstock Agents Australia, Australian Trainers Association, NSW Trainers Association and Equine Veterinarians Australia. The code is the strongest in the world alongside the United States? code and introduces a Complaints Advisory Panel to which an aggrieved party can seek a resolution without having to resort to expensive and time consuming legal action.

Speaking on behalf of the signatory parties, Thoroughbred Breeders Australia CEO Peter McGauran said that the reforms would strengthen existing safeguards and generate greater confidence in the sales system.

?Complaints against agents ? defined as any person representing or advising a buyer or seller at a sale ? are infrequent to the point of being rare but all of us have a vital interest in maintaining confidence in the sales system and answering any criticisms however ill-informed or unjustified. We have jointly agreed on a new Code of Conduct not because of any identifiable problems, but because we want to meet and even exceed the highest standards possible expected of us by buyers and the general community,? Mr. McGauran said.

The major features of the new code are:

No agent may act in an unethical, dishonest or disreputable manner and must act at all times in the interests of their client to the exclusion of all other interests including their own
An agent must obtain from their client a written form accurately recording the terms of engagement
An agent must disclose to their client any payment or commission they receive from any other person
An agent must not offer any secret commission or payment to another agent which is not disclosed to the prospective buyer or that is intended to induce an agent to act otherwise than in the best interests of their client
An agent must not make any false or misleading statement nor engage in any conduct intended to falsely inflate the price of bloodstock in respect of which they are acting
An agent must not purchase or acquire any interest in bloodstock in respect of which they are acting as an agent for a seller
A seller who has an ownership interest in bloodstock being offered for sale must not make any statement concerning the bloodstock which is false or misleading
A seller who has an ownership interest in bloodstock being offered for sale must accurately disclose the details of such ownership to the company conducting the sale
A seller must consent to those details being provided on a confidential basis to registered buyers who have a bona fide interest in purchasing the horse.

?The code imposes a number of specific obligations on agents in regard to disclosure as well as prohibiting payment of inducements or secret commissions. Importantly, however, the code incorporates sweeping provisions under which agents are held to the highest ethical and professional standards of their professions. We are confident that every potential wrongdoing is covered by the code which has been two years in the drafting,? Mr McGauran said.

Mr. McGauran said that a Complaints Advisory Panel would consider any allegation that an agent had breached the code with the aim of settling the dispute without recourse to legal action.

?The Panel?s responsibility is to use its best endeavours to conciliate and mediate any dispute taking into account written submissions and a conference with the complainant and respondent. If no resolution is possible, then the complainant will be advised of their legal rights and, if necessary, the conduct of the agent referred to their relevant professional association for action under their disciplinary rules. Licensed persons will be dealt with under the rules of racing.?

?I wish to thank all of the signatory parties for their commitment to reform and renewal thereby ensuring the highest practical ethical standards govern Australian Thoroughbred sales,? Mr. McGauran concluded.

Thoroughbred Breeders Australia

Horses bred in the North East continue to excel and the region?s latest star is one particularly tough lass ? last Saturday?s Gr.3 Bletchingly Stakes winner Mid Summer Music having to overcome the odds to even make it to the track.

A daughter of Noor Elaine Farm?s underrated Oamaru Force, Mid Summer Music did not have an easy start to life, her dam ? the Warwick Farm winner Samsara Lass ? dying as she foaled her talented daughter.

Subsequently hand raised ? a lamb her best friend ? Mid Summer Music was not the easiest horse to educate, co-breeder John Ivill having the difficult task of breaking her in.

?She?d try to kick and bite,? he recalled, knowing even in those early stages that the chestnut possessed a tough personality ? ?she was the boss of everyone in her paddock.?

John had teamed with Noor Elaine?s manager Mark Calwell and fellow Noor Elaine worker Darren Astbury to breed Mid Summer Music, the trio purchasing the Oamaru Force nomination from a football club charity auction.

?The aim was to breed a colt to raise and hopefully sell to Asia,? John recalled ? adding that ?it was a bit of a disaster from the start!?

Samsara Lady, also dam of the six times winner Time To Shine, had belonged to one of John?s best clients Max Smart and her loss is now being keenly felt.

?She was pretty well bred,? John said ? noting that the daughter of Nassipour was a granddaughter of the Irish 1000 Guineas winner Black Satin.

Selling the orphan filly to friends, John and Mark have thoroughly enjoyed the career of Mid Summer Music who kicked off her career with a Warracknabeal victory in February last year.

It was not a win that impressed trainer Peter Moody who admits that he would?ve been happy to move her on but both John Ivill and jockey Linda Meech convinced him that she had talent worthy of perseverance.

And connections have not looked back, Mid Summer Music now an eight times winner from 13 starts ? amassing over $300,000 in stakes.

?She?s a serious racehorse who has just got better and better,? John said ? ?she just has that great will to win.?

Mark agrees ? ?she was always pretty tough and that shows in her racing.?

Mark is looking forward to Oamaru Force, a Gr.3 winning son of Geiger Counter, attracting more mares this spring.

?We have another one in the pipeline who looks like being stakes class and we are hoping people will really start to sit up and take notice.?

Also sire of the dual Group winner Diplomatic Force, Oamaru Force has never served large books of mares but he is doing, as Mark enthused ?a helluva job!?

A handsome chestnut who Mark says is ?jumping out of his skin and ready to go,? Oamaru Force is also sire of the talented Hong Kong based gelding Good Words who has won four races at Shatin and Happy Valley ? having won by seven lengths at his only local outing at Moonee Valley.

Rocking Force is another good advertisement for the breed, the consistent gelding winning two in a row at Sandown in Moonee Valley earlier this year. Lightly raced four-year-old Ben Zena also shows excellent potential with easy wins at Moonee Valley (nearly four lengths) and Sandown in June/July whilst in Perth Earl Of Vasse has won two of his last three at Belmont.

Taunt Pauline is also a last start metropolitan winner at Eagle Farm and there is no doubt that Oamaru Force ? a stallion John Ivill describes as ?a sleeper? ? has the ability to upgrade his mares and sire a very smart galloper.

Check out Noor Elaine Farm?s Internet site at: www.nef.com.au and keep up to date with North East news at www.northeastthoroughbreds.com.au/

just wondering if it is just me or is this horse in a rich vain of form as a stallion at the moment. i know he had every oppurtunity to succeed but didnt fire a shot early. as his progeny reach 3 and 4 they seem to be getting better. i wonder how many of his progeny out of quality mares were condemned because of physical or mental immaturity. he may well have suffered the WA breeding curse of no 2yos no good.
